Brian has argued criminal appeals and post-conviction writs before eighteen different state and federal appellate courts. He has handled virtually every type of criminal appeal, including capital murders, murder, sexual assaults, illegal possession & distribution of controlled substances, theft, election fraud, driving while intoxicated, intoxication manslaughter & assault, family violence, and other offenses. He has concentrated his post-conviction writ practice in the area of ineffective assistance of trial and appellate counsel, that is, lawyers who previously failed to adequately represent their clients at trial or appeal.

Brian has also served the people of the State of Texas as a special prosecutor in a trio of cases: defending the capital murder conviction and death sentence of Dexter Johnson, securing prison time for former District Attorney Investigator Dustin Deutsch for theft by a public servant, and prosecuting Texas Attorney General Ken Paxton for securities fraud and failing to register as an investment advisor representative.
Brian was a visiting county criminal court at law judge in Harris County and was an associate municipal court judge for the City of Houston from 1995 to 2005. He also serves as a Special Master in post-conviction writ matters for the Harris County District Courts.
